Terms of Service

1. Acceptance of Terms

By accessing or using BreakAuctions ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We reserve the right to modify these terms at any time, with changes taking effect upon posting.

2. Eligibility

You must be at least 18 years of age to participate in any auction on the Platform. By creating an account, you represent and warrant that you meet this age requirement and that you are legally permitted to participate in prize competitions in your jurisdiction. It is your sole responsibility to determine whether participation is lawful in your location.

3. How Auctions Work

Each auction on the Platform operates as follows:

• A fixed number of spots are available for each auction at a fixed price per spot.
• Each spot purchase is final and non-refundable once payment is confirmed, except where all spots do not sell before any applicable deadline.
• The draw occurs when all spots are sold, or at the stated deadline if one is specified.
• The called spot is selected using Random.org, a certified independent randomness service.
• The winner is notified by email and publicly posted on the Winners page.
• Prizes are delivered within 5 business days of the draw for physical items, or within 24 hours for digital prizes.

4. Payments

All payments are processed securely via Stripe (card) or NOWPayments (cryptocurrency). By completing a purchase, you authorize the applicable payment processor to charge your selected payment method. All prices are listed in USD. Cryptocurrency payments are subject to the exchange rate at the time of the transaction. We are not responsible for network fees or delays associated with cryptocurrency payments.

5. Refund Policy

Spot purchases are non-refundable once payment is confirmed and spots are assigned. If an auction is cancelled by BreakAuctions before a draw occurs, all entrants will receive a full refund to their original payment method within 5–10 business days. Refunds for cryptocurrency payments will be issued in the same currency at the rate applicable at the time of refund.

6. Prizes

Prizes are as described on each auction page. We reserve the right to substitute a prize of equal or greater value if the stated prize becomes unavailable. Prize values are approximate retail values at the time of listing. Winners are responsible for any taxes, duties, or import fees applicable to their prize in their jurisdiction.

7. Prohibited Conduct

You agree not to:

• Create multiple accounts to circumvent entry limits.
• Use automated systems, bots, or scripts to purchase spots.
• Attempt to manipulate, interfere with, or exploit the draw process.
• Use stolen, fraudulent, or unauthorized payment methods.
• Engage in chargebacks except in cases of unauthorized transactions.
• Violate any applicable laws or regulations.

Violation of these rules may result in immediate account termination, forfeiture of entries, and potential legal action.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of BreakAuctions and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, BreakAuctions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid for the specific auction entry giving rise to the claim.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which BreakAuctions is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by applicable law.
