Terms of Service

1. Acceptance of Terms
By accessing or using BreakAuctions ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We reserve the right to modify these terms at any time, with changes taking effect upon posting.
2. Eligibility
This prize competition is open only to legal residents of Canada who are at least 19 years of age (the age of majority in the applicable province or territory), EXCLUDING residents of the Province of Quebec, and is void where prohibited by law. Employees, officers, directors, and agents of BreakAuctions, and members of their immediate families or households, are not eligible to enter or win. By creating an account, you represent and warrant that you meet these requirements and that you are legally permitted to participate in a prize competition in your jurisdiction. It is your sole responsibility to determine whether participation is lawful in your location.
3. How the Prize Competition Works
Each prize competition on the Platform operates as follows:
- A fixed number of entry spots are available for each competition. No purchase is necessary to enter or win — see the No Purchase Necessary / Free Entry section below.
- Each paid spot purchase is final and non-refundable once payment is confirmed, except where all spots do not fill before any applicable deadline.
- The draw occurs when all spots are filled, or at the stated deadline if one is specified.
- The winning spot is selected using Random.org, a certified independent randomness service.
- Before any prize is awarded, the selected winner must correctly answer a mathematical skill-testing question — see the Skill-Testing Question section below.
- The winner is notified by email and publicly posted on the Winners page.
- Prizes are delivered within 5 business days of the draw for physical items, or within 24 hours for digital prizes.
4. Payments
All payments are processed securely via Stripe by card. By completing a purchase, you authorize the payment processor to charge your selected payment method. All prices are listed in Canadian dollars (CAD).
5. Refund Policy
Paid spot purchases are non-refundable once payment is confirmed and spots are assigned. If a prize competition is cancelled by BreakAuctions before a draw occurs, all entrants who paid will receive a full refund in Canadian dollars (CAD) to their original payment method within 5–10 business days.
6. Prizes
Prizes are as described on each prize competition page. We reserve the right to substitute a prize of equal or greater value if the stated prize becomes unavailable. Prize values are approximate retail values at the time of listing. Winners are responsible for any taxes, duties, or import fees applicable to their prize in their jurisdiction.
7. Prohibited Conduct
You agree not to:
- Create multiple accounts to circumvent entry limits.
- Use automated systems, bots, or scripts to purchase or obtain spots.
- Attempt to manipulate, interfere with, or exploit the draw process.
- Use stolen, fraudulent, or unauthorized payment methods.
- Engage in chargebacks except in cases of unauthorized transactions.
- Violate any applicable laws or regulations.
Violation of these rules may result in immediate account termination, forfeiture of entries, and potential legal action.
8. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of BreakAuctions and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Limitation of Liability
To the maximum extent permitted by law, BreakAuctions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid for the specific prize competition entry giving rise to the claim.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You and BreakAuctions irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario for the resolution of any dispute arising out of or relating to these Terms or any prize competition, except where prohibited by applicable law.
11. No Purchase Necessary / Free Entry
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A purchase will not improve your chances of winning. Every prize competition on the Platform can be entered free of charge, either online or by mail.

12. Skill-Testing Question
Before any prize is awarded, a selected winner must, as a condition of being declared a winner and receiving the prize, correctly answer a mathematical skill-testing question without mechanical or other assistance. If the selected entrant fails to correctly answer the skill-testing question, declines the prize, or cannot be contacted, they forfeit the prize and an alternate winner may be selected in the same manner.
13. Eligibility
This prize competition is open only to legal residents of Canada who have reached the age of majority in their province or territory of residence (19 years of age or older), EXCLUDING residents of the Province of Quebec, and is void where prohibited by law. Employees, officers, directors, and agents of BreakAuctions, and the members of their immediate families and households, are not eligible to enter or win.
14. Winner Selection & Odds
Winners are selected by a provably-fair random draw conducted using Random.org, a certified independent randomness service. The odds of winning depend on the total number of entries (paid and free) received in each prize competition. Free and paid entries are pooled together and have an equal chance of being selected.
